THE
SEPARATION of CHURCH
A
Purposely Fabricated Fallacy and a Sham
Elder James D. Bradley
The A.C.L.U. and the Liberal Establishment, with the help of the courts and law schools of
this country, have re-written the Constitution without ever holding a Constitutional
Convention.
Note: The term Separation of Church and State does not appear in
the Constitution, Declaration of Independence, Bill of Rights nor the official writings of
our Founding Fathers. Thomas Jefferson, in a personal letter to the Danbury Baptist
Association dated January 1, 1802, referred to "a wall of separation". He was
merely calming the fears of the Baptists that the Congress was in the process of choosing
any one Christian denomination as the official State denomination. The Constitution refers
to the "establishment of religion", which is clearly explained in Mr. Badger's
report from the Senate Judiciary Committee.
The ONLY way to interpret the Constitution, is to do as Thomas Jefferson (the Liberals
Standard-bearer) said to do. It must be done with an eye towards the "ORIGINAL
INTENT". You must look at the Constitution the same way that the Christian looks at
the Bible if you are sincere about finding the truth concerning the founding fathers
"intent" as it pertained to the separation of church and state.
When one reads the Bible, he must seek to understand the time period that a given Law is
issued to the people and then he must seek to understand whether that Law would apply to
all generations or just the people that it was given to. He must also seek to understand
the customs and belief's of the people at the time the Laws were given, so as to be able
to understand the impact that the Lawgiver desired.
The same holds true for the
Constitution. WE MUST LOOK AT THE FOUNDING FATHERS WORDS TO UNDERSTAND "WHAT THE
CONSTITUTION WAS MEANT TO CONVEY." If the A.C.L.U. and the lawschools, courts and
Liberal Establishment don't like what the "intent" was, then let them do as
anyone with an ounce of honesty and integrity would do. Call for a Constitutional
Convention and get the people to authorize the changes they want, provided that those
changes don't infringe on our "Unalienable Rights".
CONSIDER THESE PROOFS:
FICTION: Based on the wording of the First Amendment to the Bill
of Rights, Liberals would have us to believe that the founding fathers were adamant that
God and Religion be kept out of our public school systems.
FACT: Congressman Fisher Ames from Massachusetts, on August 20,
1789 suggested the wording of the First Amendment, which was adopted by the house.
"Congress shall make no law establishing religion, or to prevent the free exercise
thereof, or to infringe the rights of conscience".
FACT: Fisher Ames, said Congressman above, in his own words on the
subject of God and Religion in our public school systems; "Should not the Bible
regain the place it once held as a schoolbook? Its morals are pure, its
examples are captivating and noble...The reverence for the sacred book that is thus early
impressed lasts long; and, probably, if not impressed in infancy, never takes firm hold of
the mind...In no book is here so good English, so pure and so elegant, and by teaching all
the same they will speak alike, and the Bible will justly remain the standard of language
as well of the faith".
note: Here, in the words of the very man who chose the explicit
wording to the "establishment clause", any reasonably sensible person can see
that he had no intention what ever of keeping religion out of the public [government]
schools.
FACT: The United States Supreme Court in 1844 on case #43 U.S.
126, 132. Justice Joseph Story delivered the courts opinion regarding a request that
the estate of a deceased deist, who wanted to establish an orphanage and school with the
stipulation that no religious influence be allowed.
The city of Philadelphia rejected
the proposal, as their lawyers declared:
"The plan of education proposed is anti-Christian, and therefore repugnant to the
law...The purest principles of morality are to be taught. Where are they to be found?
Whoever searches for them must go to the source from which a Christian man derives his
faith-the Bible...There is an obligation to teach what the Bible alone can teach, viz. a
pure system of morality... No fault can be found with Girard for wishing a marble college
to bear his name for ever, but it is not valuable unless it has a fragrance of
Christianity about it."
THE COURT RULED:
"Christianity...is not to be maliciously and openly
reviled and blasphemed against, to the annoyance of believers or the injury of the
public..It is unnecessary for us, however, to consider the establishment of a school or
college, for the propagation of...Deism, or any other form of infidelity. Such a case is
not to be presumed to exist in a Christian country...Why may not laymen instruct in the
general principles of Christianity as well as ecclesiastics...And we cannot overlook the
blessings, which such [lay]men by their conduct, as well as their instructions, may, nay
must impart to their youthful pupils. Why may not the Bible, and especially the New
Testament, without note or comment, be read and taught as a divine revelation in the
[school]-its general precepts expounded, its evidences explained and its glorious
principles of morality inculcated?..Where can the purest principles of morality be learned
so clearly or so perfectly as from the New Testament? It is also said,
and truly, that the Christian religion is a part of the common law of Pennsylvania...
FACT: United States Supreme Court 1952, in the case of Zorach v.
Clauson, 343 US 306 307 313, Justice William O. Douglas delivered the courts
decision, stating: The First Amendment, however, does not say that in every respect there
shall be a separation of Church and State. Rather, it studiously defines the manner, the
specific ways, in which there shall be no concert or union or dependency one on the
other....We find no constitutional requirement makes it necessary for government to be
hostile and throw its weight against the efforts to widen the scope of religious
influence.... We cannot read into the Bill of Rights such a philosophy of hostility to
religion.
note: even as late as 1952 the Supreme Court recognized that the
Founding Fathers meant that they did not want a "church led state", not that
they wanted to expel religion from government.
note: We see that as early as 1952, the Liberal Establishment has
already reached the Supreme Court with their assault on the Establishment Clause.
FACT: United States Supreme Court 1963, case #374 U.S. 203,212,225
records Associate Justice Tom Clark : "Secularism is unconstitutional ...preferring
those who do not believe over those who do believe...It is the duty of the Government to
deter no-belief religions...The State may not establish a "religion of
secularism" in the sense of affirmatively opposing or showing hostility to religion,
thus preferring those who believe in no religion over those who do believe..."
note: As early as 1963, the Supreme Court recognized the movement
in this
country, led by the A.C.L.U., to try to eradicate religion in favor of the infidels who
would try to make this a Godless society (which they unfortunately have succeeded fairly
well at this point in time).
FACT: United States Supreme Court 1973, case #475 F.2nd. 29, 33,
34, [concerning the Ten Commandments] stated: But this creed does not include any element
of coercion concerning these beliefs unless one considers it coercive to look upon the Ten
Commandments. Although they are in plain view, no one is required to read or recite them.
It does not seem reasonable to require removal of a passive monument, involving no
compulsion, because its accepted precepts as a foundation for law, reflect the religious
nature of an ancient era.
note: As late as 1973, this country still acknowledges that our
laws and our justice system are based on the Biblical Laws and systems.
FACT: The United States Supreme Courts decision in 1985 on
case #472U.S.,38,99, as rendered by Associate Justice William Rehnquist reads: "It is
impossible to build sound constitutional doctrine upon a mistaken understanding of
Constitutional history...The establishment clause had been expressly freighted with
Jeffersons misleading metaphor for nearly forty years... There is simply no
historical foundation for the proposition that the framers intended to build a wall of
separation[between church and state]... The recent court decisions are in no way based on
either the language or intent of the framers".
note: Here, is a true and accurate description of the distortions
that the courts have unethically and erringly allowed the A.C.L.U. to present as facts
when they are indeed, known falsehoods.
FACT: Congress of the United States of America January 19, 1853 as
part of a Congressional investigation, records the report of Mr. Badger of the
Senate Judiciary Committee: The [First Amendment] clause speaks of "an
establishment of religion." What is meant by that expression? It referred, without
doubt, to that establishment which existed in the mother-country... endowment at the
public expense, peculiar privileges to its members, or disadvantages or penalties upon
those who should reject its doctrines or belong to other communions-- such a law would be
a "law respecting an establishment of religion..." They intended, by this
amendment, to prohibit "an establishment of religion" such as the English Church
presented, or
anything like it. But they had no fear or jealously of religion itself, nor did they wish
to see an irreligious people...Sunday, the Christian Sabbath, recognized and respected by
all the departments of the Government...Here is recognition by law, and by universal
usage, not only of a Sabbath, but of the Christian Sabbath, in exclusion of the Jewish or
Mohammedan Sabbath...the recognition of the Christian Sabbath [by the Constitution] is
complete and perfect. We are a Christian people...not because the law demands it, not to
gain exclusive benefits or to avoid legal disabilities, but from choice and education; and
in a land thus universally Christian, what is to be expected, what desired, but that we
shall pay due regard to
Christianity.
note: Here, is indisputable proof of the
Founding Fathers "intent" that this should be a Christian Nation, but not a
nation ruled by the Church. There should be no doubt in any reasonable minds what the
Founding Fathers and the Congress of this young nation intended by the "establishment
clause", and it bears no resemblance to the views forced upon society today at the
hands of the A.C.L.U. and the Liberal establishment. How much clearer could something
be??? Can you still deny the truth?????It doesnt matter whether it is desirable to
the masses today!!! It simply is the truth about our heritage and our Constitution!!!!!
FACT: Virtually everyone of the 55 writers and signers of the
Unites States
Constitution of 1787, were members of Christian denominations: 29 were Anglicans, 16 to 18
Calvinists, 2 were Methodists, 2 were Lutherans, 2 were Roman Catholics, 1 lapsed Quaker
and sometimes Anglican, and 1 open Deist- Dr. Franklin who attended every kind of
Christian worship, called for public prayer, and contributed to all denominations.
FACT: On July 4th, 1821, John Quincy Adams declared: "The
highest glory of the American Revolution was this; it connected in one indissoluble bond
the principles of civil government with the principles of Christianity. From the day of
the Declaration...they (the American people)were bound by the laws of God, which they all,
and by the laws of the Gospel, which they nearly all, acknowledge as the rules of their
conduct."
note: Again, the words of our founding fathers clearly show the
falsehood presented today at the hand of the A.C.L.U. and the Liberal
Establishment.
FACT: Continental Congress September 10, 1782, in response to the
need for Bibles which again arose, granted approval to print "a neat edition of the
Holy Scriptures for the use of schools."
note: the following Endorsement of Congress was printed on its
front page;
"Whereupon resolved, that the United States in Congress assembled... recommend this
edition of the Bible to the inhabitants of the United States..."
FACT: On January 1, 1802, Thomas Jefferson wrote a letter to the
Danbury Baptist Association of Danbury Connecticut, calming their fears that Congress was
not in the Process of choosing any one single Christian denomination in order to make it
the "state" denomination, as was the case with the Anglican Church in England
and Virginia.
note: This is the letter that the "misleading
metaphor" was taken from, and has been intentionally misleading the
American people for 50 years now at the behest of the A.C.L.U. and the Liberal
Establishment.
note: Thomas Jefferson did not sign the Constitution, nor was he
present at the Constitutional Convention of 1787. Neither was he present when the First
Amendment and religious freedom were debated in the first session of Congress in 1789( so
in his own words we would have to look to those who were there and examine their
positions), as he was out of the country in France as a U.S. Minister.
FACT: To any sane and reasonable reader there is more than enough
evidence to convict the Liberal Establishment of perpetrating fraud on the American
people.
There is much more evidence available if one is inclined to more research.
note: The Liberal Establishment always tries to blame the moral
decay of this nation on the "rich" conservatives.[they do have enough faults but
that is not one of them]. The truth is, that it was the war on Christianity led by the
A.C.L.U. and its Liberal followers that caused this nation to put Secular Humanism
at the helm of the country instead of Jesus Christ, as was required in Gods Covenant
with our nation. All of the social programs in the world will not set this nation back on
the path of righteousness.
CONCLUSION: Here, we have, from the lips of the founding father
who authored this said First Amendment, evidence in support of my position [that the
Liberal establishment has perverted the meaning and intent of our Founding Fathers as it
pertains to the "Establishment Clause"], along with many others from the lips of
those who were partakers in the creation of this great country.
Knowing that the Liberal
Establishment hold themselves as experts in such matters, we must conclude that they have
also availed themselves of this evidence. As stated before, they are willing to push the
truth into the dark hallways of the past, and forge ahead with the rewriting of history to
justify their (revised) positions.
No matter how offensive Jesus
Christ and His church are to these multi-culturalists and no matter how rabidly angry they
are about our early history and heritage, they cant simply change history because
they dont like it the way it was. They cannot continue to be dishonest with their
trickery and deceit about our Constitution and Bill of Rights.
Let them for once be upright and
honest and seek to get the American people to denounce these beliefs. Until such time we
will hold these proofs as sufficient to show that Liberalism has rewritten history in
order to advance the form of Government that "they" envision, not the one
"that the Founding Fathers envisioned."
To those who doubt or question whether the courts and law schools have acted in
concert with the Liberal Establishment in circumventing the Establishment Clause as it was
intended, please investigate the following information.
According to Mr. Howard Simon,
Michigan Director of the A.C.L.U.(at the time this article was written), "The
Treatise on Constitutional Law" by Ronald D. Rotunda and John E. Nowak, published by
the West Publishing Co., St. Paul, Minnesota, is the basic constitutional law textbook
that is used by virtually every law school in this country. In Section 21.3, the
introduction to the Establishment Clause, one only has to read three lines deep to
see the evidence of my claims that the Founding Fathers vision is the exact opposite
of the view held today.
The third line reads:
"While at it's inception the clause might not have been intended to prohibit
governmental aid to all religions, the accepted view today is that it also prohibits a
preference for religion over non-religion." This sentence explains exactly
what has transpired without the people being aware. It states emphatically that "at
it's inception, the Establishment Clause fully endorsed aiding at l east one
religion".
Anyone that is intellectually
honest has to admit that the Christian Religion
is the only religion that the framers of the Constitution intended to aid. Not only did
they change the "intent to aid", they purposely went farther in their assault on
the establishment clause and reversed the "intent" to prefer the Christian
Religion over other religions.
The written record of the
Founding Fathers words is replete with evidence that they "intended" to aid AND
prefer the Christian Religion over all
others, yet still "intended" that those other religions be free from
governmental interference, to practice their belief's as their conscience dictated.
There should be no doubt in any
reasonable mind that the Establishment Clause has been circumvented, and it was
circumvented un-Constitutionally because it has all been done subversively without the
authority of a Constitutional Convention, to advance the cause of secular humanism at the
expense of all American's Rights.
I truly believe that the A.C.L.U. has done such an outstanding job of
promoting this falsehood, that even if the American people were shown the truth, they
would choose to accept their interpretation for it leaves them free from answering to God.
This is why I believe, as I said before, that the A.C.L.U. has to accept much of the
responsibility for the moral collapse of this nation. They are responsible for creating a
climate of hatred towards religion, and for that they will have to answer to that God that
they have
persecuted.
If anyone can show me, with our Founding Fathers words, where I am wrong, I would truly
like to know. For I do not want to lead anyone astray as to the truth. My faith doesnt
hinge on what anyone else believes, but on what I believe. So please show me, with the
words of our founding fathers, where I err.
Note: The serious student of the Constitution will find that the
A.C.L.U. and the Liberal Establishment (it does exist) have perverted the Constitution in
the following manner:
1st Amendment: broadened Freedom of Speech to include
"expression" (which is an open door to virtually anything some Jurist embraces),
"original intent" was to protect political speech (not vulgar satire) not the
pornography and other forms of filth, completely reversed the original meaning of
respecting the Establishment of Religion (there is ample documentable evidence).
2nd Amendment: Right to bear arms has been restricted over and
over, and is headed towards a total ban, a complete reversal of "original
intent".
5th Amendment: Miranda ruling expanded self incrimination to
protection of the guilty, and due process and private property clauses are violated by the
"rico" act.
8th Amendment: cruel and unusual punishment expanded to void
anything more than a handslap outside of death penalty and that has been virtually unused
when compared to the number of crimes committed that call for it.
9th Amendment: According to Judge Robert Bork, it's an ink blot.
So vague as to be useless. (probably a good thing for America)
10th Amendment: Virtually ignored and trampled on by the entire
Legislative Branch of our government. All dept.'s not specifically designated should be
disbanded and returned to the people or the states.
14th Amendment: expanded Right to Life, Liberty and Property to
include "privacy" which in turn was expanded to include abortion. A complete
travesty against "original intent".
I find it mind-boggling that the Liberals can swing from a strict interpretation
to a wide open assault on any given enumerated Right, often going from
one side to the other in the very same Amendment, and still maintain any sense of
credibility! Look at the 1st Amendment, they take a VERY LITERAL interpretation on the
Rights to free speech (which I dont think the founding fathers would agree with),
then in the same verse literally swing the gates open as to the Establishment Clause
(and anyone who has read their writings, knows that the founding fathers would reject the
Liberals interpretation of the Establishment Clause).
Look at the various Amendments and it is easy to tell which ones will be literal
interpretations (the ones they agree with) and the ones which will receive the wide open
assault (the ones that they disagree with). Thats not the way the
Constitution was constructed. It was written with the belief that the men who
were elevated to the Judiciary would be of such impeccable honesty and integrity that they
would not allow their personal
preference to sway their rulings (something that is common place among even the Supreme
Court today).
One could expand greatly on the assault on the Constitution if so desired, but the
greatest assault, in my mind, is the assault on the Establishment clause. For, if we
recall the words of our 2nd. President, John Adams we see why, or I should say, HOW, all
of the other assaults came about. President John Adams stated on Oct.11, 1798: " Our
Constitution was made only for a moral and religious people. It is wholly inadequate to
the government of any other."
We are no longer a "religious people". We have a "form of Godliness",
but by our "fruits" we have shown that our form of religion is only a shadow of
that which was given unto Moses. No true Christian, whose only desire is to live in a
world (Heaven) governed ONLY BY JESUS CHRIST, could turn around and say that Jesus has no
place in THIS world's government.
That is the ONLY way to turn this
country around, yet, I'm afraid that most so called Christians do not have the courage nor
the desire to stand up and declare such a truth. It's to them and those who don't seem to
know how to turn things around that I offer the following (inspired by The Truth & the
Light by Peter Marshall):
"AMERICA
, AMERICA, GOD SHED HIS GRACE ON THEE"
Not many years ago the sound of those words would cause most Americans to feel a sense of
pride that is all but forgotten today . The sound of those words would make your bosom
swell with pride and bring tears to your eyes, as a chill would run up and down your
spine.
Not that long ago, people all over the world proclaimed this country "the land of
liberty and the home of the free". We were an ensign to the world that God was the
head of this nation. We were a moral and a righteous people, as well as a deeplyreligious
nation.
We were the richest nation of the world and our dollar was held up as the standard by
which all moneys were to be compared. We had pride in this nation, and our homes and our
schools were safe. Our children were taught moral values in school and they started each
schoolday with a prayer.
It wasnt that long ago that we trusted our policemen and our preachers and our
government. We were the technological giant of the world. We were making leaps and bounds
toward making this world a better place to live in.
Then it all came apart. Today we are a nation without a soul. Crime and murder are a part
of everyday life and we are afraid for our children to even walk to the corner anymore.
The experts in academia and government are at a loss to explain this sudden collapse of
such a great nation, and are incapable of curing what ails our people. They cant see
what (it is claimed) Alexis de Tocqueville, a famous French statesman, historian and
social philosopher saw. In the 1830s after touring the United States of
America, to observe their
people and their institutions, he stated : " I sought for the key to the greatness
and genius of America, in her harbors...; in her fertile fields and boundless forests; in
her rich mines and vast world commerce; in her public school system and institutions of
learning.
I sought for it in her democratic Congress and in her matchless Constitution. Not until I
went into the churches of America and heard her pulpits flame with righteousness did I
understand the secret of her genius and power. America is great because America is good,
and if America ever ceases to be good, America will cease to be great!!!!!"
They cant see what he and every true Christian knows is the reason for this sorry
state of affairs. Satan has deceived the leaders of academia and government and caused
them to remove Jesus Christ from His rightful place at the helm of this nation.
"We" are the answer to this problem. We have to stop being the "barnyard
ducks" and start being the laborers that Christ expects us to be.
We need to study our history and
understand just how far they
have taken us from the truth concerning America and its Christian heritage. We need
to be able to defend the truth. That Christopher Columbus didnt discover America by
accident, but, as he states in his daily journal written during his voyage, that "God
put it in my mind" that there was another land across the sea. We need to teach our
children about their true heritage and demand that academia and government teach these
truths and reinstate Jesus Christ at the helm of this nation that was given to the
Gentiles for their inheritance.
God gave us this "land of
bountiful" with all of its riches and beauty that it would be the "New
Jerusalem", not the New Sodom and Gomorra!!! That it would be an ensign unto the
world. That the world would see how Gods people would prosper when they obey His
Word.
Let us leave the "barnyard muck" and soar up into the heavens and fly with the
eagles. Let us reclaim this great nation, so that once again whenever anyone hears the
phrase "America, America , God shed His Grace on Thee", every heart in the land
will swell with pride and joy that it once again is the "Home of the Free and the
Land of the Brave"!!!!!!!!!!!!!!!
